Terms of Service & Privacy Policy
Last Updated: May 19, 2025
Important Notice: These Terms of Service and Privacy Policy (collectively, “Terms”) constitute a legally binding agreement between you (“Customer,” “you,” “your”) and smol farm llc (“smol farm,” “Company,” “we,” “us,” or “our”). By accessing, purchasing, downloading, installing, or using any smol farm website, mobile or desktop application, e‑book, or related service (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Definitions
- Content: Any text, graphics, images, software, audio, video, data, or other materials provided through the Services.
- Digital Goods: smol farm e‑books, applications, in‑app purchases, and any other electronically delivered products.
- Order: Your request to purchase Digital Goods or Services, submitted via our website, app store, or other authorized channel.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) and capable of forming a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.
3. Account Registration & Security
- You may be required to create an account and provide certain information (e.g., name, email, payment details).
- You agree to provide accurate, current, and complete information and to promptly update it as necessary.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- Notify us immediately of any unauthorized use or security breach.
4. License & Intellectual Property
- All Content and Digital Goods are owned by smol farm or its licensors and are protected by intellectual‑property laws.
- Subject to your compliance with these Terms, smol farm grants you a limited, non‑exclusive, non‑transferable, revocable license to download, access, and use the Digital Goods for your personal, non‑commercial use.
- You may not copy, modify, distribute, sell, or reverse‑engineer any part of the Services except as expressly permitted by applicable law or these Terms.
5. Purchases, Pricing & Taxes
- Prices are displayed at checkout and are subject to change without notice (except where prohibited by law).
- By placing an Order, you authorize smol farm (or its payment processor) to charge the total amount to your provided payment method, including any applicable taxes.
- All sales are deemed completed at the time access to Digital Goods is made available to you.
6. Refund Policy
All sales of Digital Goods are generally considered final. Because Digital Goods are delivered instantly and cannot be “returned,” smol farm reserves the right to deny any refund request at its sole discretion.
However, smol farm is committed to customer satisfaction and may—but is not obligated to—grant a partial or full refund, store credit, or replacement in the following limited circumstances:
- Technical Defect: The Digital Good is materially defective and we are unable to remedy the defect within a reasonable time after you contact support.
- Incorrect Item Delivered: You received a Digital Good that materially differs from the description at the point of purchase.
- Documented Failure of Customer Support: You can demonstrate that smol farm’s customer‑service response to a valid support request was unreasonably delayed (e.g., no substantive reply within 14 business days) or materially negligent.
To request a refund, contact support@smol.farm within 14 days of purchase and include your Order number, a description of the issue, and any supporting evidence. We will review your request in good faith and respond within a reasonable timeframe. Our decision on refunds is final.
Nothing in this section affects any non‑waivable statutory rights you may have under applicable consumer‑protection laws.
7. Acceptable Use
- Violate any applicable laws, regulations, or third‑party rights.
- Use the Services to transmit harmful code or for fraudulent, harassing, or defamatory purposes.
- Circumvent or interfere with any security or access‑control measures.
- Use automated means (e.g., bots, scrapers) to access the Services without our prior written consent.
8. User‑Generated Content (“UGC”)
- You retain ownership of your UGC but grant smol farm a worldwide, non‑exclusive, sublicensable, royalty‑free license to use, reproduce, distribute, modify, publicly display, and create derivative works from your UGC in connection with operating and improving the Services.
- You represent that you have all rights necessary to grant this license and that your UGC does not infringe any third‑party rights.
9. Third‑Party Services & Links
The Services may contain links to or integrations with third‑party websites or services. smol farm does not endorse and is not responsible for any third‑party content, products, or practices. Your dealings with third parties are solely between you and the third party.
10. Disclaimer of Warranties
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, smol farm disclaims all express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non‑infringement. smol farm does not warrant that the Services will be uninterrupted, error‑free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, in no event will smol farm, its affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Services or these Terms, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. smol farm’s total liability to you for any claim arising from or related to the Services will not exceed the greater of (a) the amount you paid to smol farm for the Digital Good giving rise to the claim or (b) USD 50.
12. Indemnification
You agree to defend, indemnify, and hold harmless smol farm and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of the Services.

14. Termination
smol farm may suspend or terminate your access to the Services at any time, with or without notice, for any breach of these Terms or for any other reason. Upon termination, all licenses granted to you will automatically terminate, and you must cease all use of the Services.
15. Changes to the Terms
We may modify these Terms from time to time. If we make material changes, we will provide notice via the Services or by other reasonable means. Your continued use of the Services after the effective date of the modified Terms constitutes your acceptance.
